Ex-CEO Adam Rytenskild’s unfair dismissal case against Tabcorp is set to progress to case management hearings in the Federal Court over the next three months.

Justice Elizabeth Raper made directions for the case on Wednesday with the next hearing set down for August 12, following discovery.

Evidence in the case will then be submitted over the next two months before a further hearing is scheduled in the week commencing October 27.

The seven Tabcorp board directors at the time of Rytenskild’s sudden departure in March 2024 are listed as respondents in the case, along with Tabcorp.

Rytenskild won the right to take his case to the Federal Court after a ruling in the Fair Work Commission in November last year. That hearing set out the timeline of events which led up to Rytenskild’s sudden departure.

Rytenskild left Tabcorp after being confronted by an allegation he made an inappropriate comment made in an internal meeting in August 2023.

The sudden departure of Adam Rytenskild from Tabcorp in March this year has been ruled as a dismissal, not a resignation by the Fair Work Commission.

It was claimed that an inappropriate comment was made about the female CEO of the Victorian Gambling and Casino Control Commission.

Tabcorp had argued at Fair Work that Rytenskild had voluntarily resigned but Gerard Boyce, the deputy Fair Work Commissioner, ruled that on the balance of probabilities that the cessation of his employment with Tabcorp was a “dismissal”.
